1. Field of application

These General Conditions of Sale (hereinafter, the "GCS") define the rights and obligations of the parties in connection with sales made through the Internet site www.renault-merchandising.com (hereinafter, the "Site"). The site is published by Renault Merchandising, a French simplified joint-stock company with stated capital of EUR 38,125, EC No.: FR 85 403 198 146, French SIRET No.: 403 198 146 00066, French APE/NAF Code: 503 A. Its registered office is located at 13 Avenue Paul Langevin, 92359 Le Plessis-Robinson Cedex, France, Phone: +33 (0)1 76 83 04 05.

The General Conditions of Sale shall apply to all sales conducted through the www.renault-merchandising.com site and their purpose is to define the contractual relationship between Renault Merchandising, the seller of the goods, and the buyer.

These General Conditions of Sale are provided in French and in English.

Renault Merchandising reserves the right to adapt or modify these GCS at any time. In the event of modification, the General Conditions of Sale in effect on the date of the order shall apply to each order. The date of the latest update of these GCS is provided at the top of the page. The Customer may save or print out these GCS.

2. Buyer's acceptance

Unless stipulations to the contrary have been agreed upon in writing by the parties, any order shall be deemed to have been given in accordance with the GCS shown below, which shall apply in full.

The Customer hereby represents that he reviewed the GCS at the time he gave his order and that he accepts them without any reservation. Consequently, any order duly validated shall imply total acceptance of these GCS and, where relevant, any special or specific conditions that may apply to one or more items.

Any stipulation to the contrary from a Customer shall not be binding on Renault Merchandising unless the latter has given its express written consent thereto.

The fact that Renault Merchandising does not avail itself of any one or more of these GCS at a specific time shall not be construed as a waiver of its right to avail itself subsequently of any one or more of the said conditions.

Renault Merchandising reserves the right to cancel or refuse any order by a customer with whom a dispute exists regarding the payment of a previous order.

3. Orders

The Customer must be at least 18 years old on the date of the order and have the legal capacity or hold parental or a guardian's consent to order from the Site.

The Customer shall receive the following as soon as necessary and at the latest, prior to delivery:
Confirmation of the conditions covering his right to retract;
The address where the Customer may file any complaints;
Information about After-Sales Service and commercial warrantees.

4. Availability

The products and prices offered shall be valid as long as they are shown on the site, within the limit of available stock.

Should a product or products be unavailable after a customer has ordered, the customer shall be so informed by e-mail or by postal letter as soon as possible.

The customer shall then have the option of cancelling the order or exchanging the order by e-mail sent to "contact@site.renault-merchandising.com" or by writing to the following address:

5. Prices

The price of the goods ordered shall be the one shown on the "renault-merchandising.com" site on the date the order is given. These prices do not include delivery costs which shall be invoiced additionally. The prices shown include VAT at the rate applicable on the date of the order. Prices may be subject to change without warning at any time. Items shall be invoiced on the basis of the price rates in effect at the time the order is recorded, subject to availability. Payment shall be made by bank card. The customer shall be connected to a secure site that will accept or refuse payment once the customer has provided the information required

6. Shipping and handling expenses

The shipping expenses shown on the order include a participation in the shipping and handling expenses for the order. They are lump-sum amounts and only the weight of the item or items ordered may cause them to vary. It is in the customer's best interest to group all items into one single order; failing this, the customer shall be billed for handling expenses for each separate order.

7. Delivery

Products on the "www.renault-merchandising.com" site may only be delivered in the countries shown on the list at the time of order. From the time payment is actually made for the order, the delivery deadline is 5 business days. This timeframe is given as an example only and Renault Merchandising may not be held liable or responsible in the event the deadline is exceeded.

8. Products

The products and items offered for sale are presented on the Site with the greatest accuracy. If, despite all these precautions, errors occur, Renault Merchandising may in no way be held liable therefor. The photographs showing the products are not contractually binding.s.

9. Transfer of ownership and risks

Ownership of the products ordered shall only be transferred to the buyer upon full payment of the price by the latter.

On the other hand, transfer of the risks of loss or deterioration of the products shall occur upon delivery and their receipt at the address given by the customer when ordering.

10. Right to retract

Pursuant to Article L.121-20 of the French Consumer Code, the customer shall have 7 full days in which to retract his order and return items he does not wish to accept, without having to provide the reasons therefore or pay any penalties, with the exception of the expenses for returning the items which the customer shall bear.

The 7 days shall begin on the date the order is delivered. Should the deadline expire on a Saturday, Sunday, holiday or a day the banks are closed, it shall be extended to the following business day.

The customer shall return the product in its original packaging, in perfect condition, accompanied by the invoice and shall state whether he wishes to be reimbursed for amounts paid or to exchange the product. The product(s) shall be returned by recorded delivery package sent to the following address:

Should the product be exchanged, shipping expenses shall be borne by the customer unless the exchange is the result of a defect, lack of conformity or imperfection duly noted by Renault Merchandising

11. Liability

The products offered comply with French laws in effect on the date they are shipped.

The choice of purchasing a product is done under the Customer's sole liability. The partial or total impossibility of using the product, in particular because it is incompatible, may not give rise to any compensation for damages, reimbursement or result in Renault Merchandising being held liable except in the event of a recognised hidden defect, lack of conformity, imperfection or the exercise of a right to retract laid down by law.

Renault Merchandising may not be held liable in the following cases:
- in the event a modification has been made to one of the products provided, unless Renault Merchandising has given its prior consent thereto;
- in the event of incompatibility;
- in the event of abnormal use or use that does not comply with the use for which the product is intended;
- in the event of use or assembling that does not comply with the instructions given in the Information and Instructions for Use provided with the products.

Renault Merchandising shall not be held liable for any consequential damage sustained because of these General Conditions of Sale, operating losses, loss of opportunity, physical damage or expenses that may arise because of the purchase and/or the use of the product.

12. Force majeure

Completion of the order may be suspended by Renault Merchandising or by the customer in the event of force majeure. The following occurrences are to be understood as force majeure events: any unforeseeable or unavoidable event that is outside the control of the parties, such as natural disasters, severe storms, fire, strikes, riots, shipping interruptions, decrees or orders by public, civil or military authorities that prevent the normal completion of the order. The deadline for completion of the order shall be extended during the entire time of the force majeure event and its consequences. Should the force majeure event delay completion of the order for more than three months, each of the parties shall be free to cancel the order. No compensation shall be owed in the event of delay or cancellation related to force majeure.

13. Computer data and civil liberties

This site has filed a Statement of Compliance with the CNIL [Commission Nationale de l'Informatique et des Libertés . French Data Protection Board], short form 48.

The personal data that are requested from the customer when an order is given are required for the sale and shall be the subject of computer processing by Renault Merchandising. They are indispensable for processing the order and handling the commercial relations with Renault Merchandising in order to provide the customer with quality service that is adapted to his needs. They are exclusively intended for Renault Merchandising, Renault SAS, and our subsidiaries for surveys, analyses, commercial operations and marketing campaigns. The information is confidential and may also be retained in order to comply with laws and regulations. No commercial use, even partial, of the data collected may be carried out with Renault Merchandising's prior written consent.

Pursuant to Articles 38, 39 and 40 of the French "Computer Data and Civil Liberties" Act as amended by the Act of 6 August 2004, the customer may access and correct the data about himself, and may refuse that data concerning him be computer processed by contacting us at the following address:

In an effort to maintain transparency and to protect your rights, Renault Merchandising shall not gather information enabling you to be identified personally unless you provide us with such information by filling in and sending us the forms appearing on the site.

14. Intellectual Property

All elements that constitute the Site, in particular the products, brand names and trademarks, texts, comments, works, illustrations and pictures (hereinafter, the "Elements") whether they be visual or by soundtrack, presented on the Site are protected by intellectual property rights such as copyrights, trademarks, patents, designs and models, and other rights (hereinafter, the "Rights").

The Rights are the full and entire property of Renault Merchandising and/or, where applicable, Renault SAS. In no event may the user avail himself/itself of any right to these Elements.

Any use, including reproduction, presentation, adaptation, or modification, of the Elements on the Site, in full or in part, shall constitute infringement of copyright that may involve the civil or criminal liability of its author.

Any user wishing to establish a link to the Site's page on his/her/its own site must first request express, prior authorisation therefor from Renault Merchandising.
